Andalusia’s new Housing Law: what the mandatory agent register changes

Since January 2026 the law requires anyone brokering home sales or rentals to be listed on an official register. What it means for you.

Andalusia’s new Housing Law: what the mandatory agent register changes

On 24 January 2026, Law 5/2025 on Housing in Andalusia came into force, after its publication in the regional gazette (BOJA) on 24 December 2025. Among many other measures, it creates a Register of Residential Real Estate Agents and makes registration a requirement to broker property in the region.

The law applies to any person or company that regularly provides brokerage, advice or management services in home sales or rentals. To register, agents will need to prove professional qualification — through a recognised title, experience or specific training in residential brokerage — and hold professional liability insurance or an equivalent guarantee. For companies, at least one responsible person must meet those requirements.

The register still has to be developed through regulations: the regional government has until 24 January 2028 to set it up. But the obligation is already law, and its purpose is clear: more transparency, more professionalism and better protection for people buying, selling or renting.

For our clients, this is good news. Working with a registered professional will mean dealing with someone who can prove training, experience and proper insurance. At Rob Laver we have worked that way for more than 35 years, and we will register as soon as the register is operational. If you have questions about how the new law affects you, just ask us.
